TRAVEL CLIENT AGREEMENT

 

This Travel Client Agreement (“Agreement”) together with the Terms and Conditions (“Terms”) at https://www.johnheathtravel.com/clientterms

 

BETWEEN:  John Heath Travel, LLC (“Agency,” “our,” “us,” or “we”) 

 

AND:  You (“you” or “your”). 

 

The Parties agree as set out below. 

 

This Agreement and the Terms become effective upon: (1) your written, digital, or electronic signature; or (2) your delivery of payment authorization to us. This Agreement and the Terms will terminate upon completion of your Trip or until terminated earlier in writing by you or us. 

 

You will: (1) carefully read and understand these Terms, your reservation confirmation, and all correspondence between you and us regarding your Trip; (2) contact us to arrange your Trip Plan sufficiently prior to travel dates to ensure availability, avoid late-Booking fees, and avoid fare increases; (3) make all deposits and payments per the schedules and dates set out in your reservation; (5) review, remain aware, and remain updated regarding travel warnings relating to your Trip by accessing the U.S. governmental travel advisory sites set out in these Terms; and (6) fully comply with the obligations to which you agree in the Terms. 

 

Planning fees, cancellation fees, change fees, and unused travel vouchers are NON- REFUNDABLE, whether or not you decide to book travel. All such fees are separate from, and in addition to, the costs of your travel. 

 

You confirm that you are an authorized user of the credit or debit card you provide to us and you authorize us, or our agents, to charge your credit or debit card for Bookings on payment dates agreed and for us to automatically charge your credit or debit card for any Cancellation Fees. 

 

Capitalized terms used but not defined in this Agreement have meanings set out in the Terms. 


FEE AGREEMENT

Cancellation Fee: For our organized hosted group cruises, with the exception of our river cruises through Transcend Cruises, you acknowledge and agree to pay a non-refundable cancellation fee of $100 per person in the event of cancellation of any travel booking made through the Agency. The cancellation fee is in addition to any other fees or penalties imposed by cruise lines, airlines, hotels, or other service providers. The cancellation fee is payable regardless of the reason for cancellation and is charged per person on the booking.

Payment: All fees specified in this Agreement are non-refundable. The cancellation fee must be paid at the time of cancellation request. Payment can be made by all major credit cards.


EXCURSION TERMS & CONDITIONS

By purchasing an excursion through John Heath Travel, you agree to the following terms and conditions:



1. Booking Eligibility

  • Excursions are exclusively available to clients booked with John Heath Travel.
  • Any excursion tickets purchased by or for individuals not booked through John Heath Travel will be cancelled without notice, and no refund will be provided.


2. Non-Refundable Policy

  • All excursion bookings are non-refundable.
  • A refund may be considered only if the excursion sells out and we are able to resell your ticket(s) to another client.
  • Refunds in such cases are not guaranteed and will be processed at our discretion.


3. Non-Transferable Tickets

  • Excursion tickets are non-transferable and may only be used by the original purchaser.
  • Name changes and ticket transfers to other guests are not permitted.


4. Excursion Modifications or Cancellations

  • John Heath Travel reserves the right to modify or cancel any excursion due to weather, safety concerns, minimum participation requirements, supplier issues, or other unforeseen circumstances.
  • In the rare event that John Heath Travel or the tour operator must cancel an excursion, a full refund will be issued.

·        All excursions booked as "private" are intended to be exclusive experiences for the booking party. However, these excursions are subject to a minimum participation requirement. If the minimum number of participants is not met, the tour operator reserves the right to include additional guests on the excursion in order to meet operational requirements. In such cases, the excursion may no longer remain private.


5. Liability Waiver

  • By participating in an excursion, you acknowledge and accept that excursions may involve certain inherent risks, including but not limited to: physical activity, outdoor conditions, transportation, and interaction with third-party providers.
  • John Heath Travel acts solely as a booking agent for these excursions and does not operate or control the excursions or their service providers.
  • As such, John Heath Travel shall not be held liable for any injury, loss, damage, delay, or inconvenience arising from or in connection with any excursion, including incidents caused by third-party operators.


6. Physical Fitness & Medical Considerations

  • It is your responsibility to assess your own physical fitness level and medical condition before booking and participating in any excursion.
  • Some excursions may involve walking, climbing, uneven terrain, or other physical activity that may not be suitable for all guests.
  • John Heath Travel and its suppliers reserve the right to deny participation to anyone they deem physically unfit to safely join an activity. No refund will be issued in such cases.


7. Travel Insurance

  • Travel insurance is strongly recommended to cover potential risks, including but not limited to: cancellation, medical emergencies, lost property, and missed excursions.
  • If you already have a policy in place, you are responsible for reviewing and increasing your coverage to include all excursions and activities within the policy’s timeframe and coverage limits.
  • John Heath Travel will not be held responsible for any costs incurred due to insufficient insurance coverage.


By proceeding with your excursion booking, you confirm that you have read, understood, and agreed to these terms.
